Environmental Issues in Commercial Real Estate

The sale of a home or condo usually assumes that there is no environmental damage to the property.  In commercial transitions the buyer can be held responsible for millions of dollars in environmental cleanup costs if they acquire a damaged property.  This session will focus on:

  • Exploring the Federal Law regarding environmental damage
  • Exploring the Florida Law regarding environmental damage
  • Discussing examples of owner liability for clean up
  • Describing the due diligence process for owners to avoid liability and create a safe harbor for environmental damage claims
  • Describing methods of risk allocation in commercial real estate transactions
  • Outline some of the tools that can be used to mitigate the cost of potential clean up liability

About the Speaker

Rebecca York, JD, MBA, has an extensive background in business as a COO of a regional multi-disciplinary commercial real estate firm and a commercial real estate banker.  Ms. York has been a member of NAIOP, ULI, CREW and CCIM and has served on the NAIOP National Capital Markets III Forum and the National CREW C-Suite Mentoring Program.  She also served on the Board of Directors of the Metro Orlando Home Builders Association and as VP of the Central Florida Chapter of CCIM.  Her training includes a JD in law use and legislation from the University of Wisconsin where she also served as intern to the Chief Justice of the Wisconsin Supreme Court.  Ms. York has an MBA from Columbia University and she has completed the NAIOP Advanced Real Estate Finance Seminar, ULI Advanced Pro-Forma Modeling and the Harvard Negotiations Course.  Ms. York has been an instructor at UCF for six years for both the graduate and undergraduate levels.
